To Whom It May Concern:


Enclosed herein is our formal Notice of Complaint filed pursuant to Section 53(1) of the Status of the Artist Act.

Our complaint alleges that Rogers Television London Cable I3, a division of Rogers Cable Inc. a wholly-owned subsidiary of Rogers Communications Inc. is contravening Section 32 of the Status of the Artist Act. Our complaint contends that Rogers Television London Cable 13 is refusing to "make every reasonable effort to enter into an agreement" with the London Musicians Association Local 279 of the American Federation of Musicians of the United States and Canada.

Subsequent to our first meeting of April 30, 2003, Scott Jackson, Station Manager of Rogers Television London Cable 13 called me on July 4, 2003 to advise us that Rogers Television London Cable 13 did not wish to have a second meeting with us towards the purpose of negotiating a scale agreement. Since that time to encourage a resumption of negotiations towards a scale agreement, I have received no response whatsoever from any Rogers official indicating such an intention. No written correspondence has been received by our office from Rogers Television London Cable 13 since March 6, 2003, the date our office issued the 'Notice to Bargain' to Rogers Television London Cable 13 under Section 31 of the Status of the Artist Act.

The London Musicians Association hopes that its complaint will be upheld and that Rogers Television London Cable 13 will resume negotiations that produce a first scale agreement between our respective organizations. We look forward to resuming negotiations with Rogers forthwith.
